A vital part of ICANN’s processes is the opportunity for there to be public comment on each substantial piece of work before it is put forward for final approval. This is an archive of one month’s public comment periods, arranged according to the month in which the comment period was closed.

Each box below provides a brief explanation of what the comment period hoped to achieve, as well as: links to relevant reports and/or webpages; a link to the official announcement of the comment period; a link to where all existing comments can be found; and an email link for anyone that wished to send in a comment. A “summary/analysis” objectively reviews the comments.

Bylaw Amendments Related to Restructuring of the GNSO Council (Version 2)

Explanation/Background:

Implementation of the Generic Names Supporting Organization (GNSO) Review/Improvements process requires the amendment of a substantial number of the ICANN Bylaws to reflect new GNSO structures, processes and mechanisms. In particular, a specific package of draft Bylaws and additional Staff recommendations has been developed for Public review and comment so that the ICANN Board can move forward with Bylaw amendments to seat the new GNSO Council by the annual ICANN meeting in Seoul, Korea. Approving the Bylaws amendments is a key step toward seating a newly structured Council consistent with the recommendations of the ICANN Board Governance Committee.

An initial set of Bylaws amendments (Version 1) were posted for public comment on 30 June 2009, reflecting the work product of a GNSO Council Restructure Drafting Team (consisting of the entire GNSO Council and additional GNSO community members), and additional Staff recommendations. The Bylaw Amendments (Version 2) [PDF, 256K] being posted for public comment today are based upon the 30 June 2009 initial version and include additional amendments that reflect guidance received by Staff from the Board’s Structural Improvements Committee (SIC) as well as other issues identified by Staff in its efforts to develop Bylaws that are internally consistent and conform to the principles of the BGC Report.

The package consists of three documents.

The Staff is opening a 21-day public consultation forum, from 3 August 2009 through 24 August 2009, and invites community comments on this topic.

Explanation:While ICANN continues to examine the overall structure of its meeting dates and geographic rotation, it is important to move forward with future planning. In an effort to secure the dates for ICANN meetings through 2013, Staff recommendations have been developed for Public review and comment. Approving the meeting dates is important to prevent conflicts with other community events and to allow all participants sufficient time to plan their travel and attendance.

The proposed dates below have been selected based on careful avoidance of important holidays, celebrations, and observances around the globe. Similarly, every effort was made to identify and prevent scheduling conflicts with other community events.

ICANN will not be able to accommodate every request for a date change. However, in an effort to be fully cognizant of holidays and occasions from countries and religions around the world, we’d like to provide an opportunity for comment so the ICANN Public Participation Committee of the Board can move forward with approving the dates.

Modification of UDRP Rules

Explanation: The implementation rules for the Uniform Domain Name Dispute Resolution Policy (UDRP) document the procedures for the implementation of UDRP proceedings (http://www.icann.org/en/udrp/udrp-rules-24oct99.htm). ICANN has received a proposal from the World Intellectual Property Organization (WIPO) regarding suggested changes to the implementation rules to allow for a paperless UDRP proceeding, or “eUDRP.”  WIPO does not propose any changes to the UDRP itself.

The WIPO proposal [PDF, 13K] includes an explanation for WIPO’s proposal, as well as a redline of the proposed rule changes.

WIPO’s proposal is being posted for public comment for 30 days to ensure broad community input. Feedback received will be considered in the evaluation of the need to modify the implementation rules to give effect to the specific purpose proposed.

Note: The proposal also includes sections relating to proposed changes to WIPO’s supplemental rules for the administration of UDRP proceedings. The public comment forum is not intended to address the supplemental rules change issues.

Bylaw Amendment Related to Organizational Review Cycles

Explanation: In its present formulation, the Section 4 of Art. IV of Bylaws contains provision for a three-year period between each consecutive review of the same key structure of ICANN.

Based on the experiences made during the first cycle of Organizational Reviews, the Structural Improvements Committee of the Board considers that a modification of Section 4 of Art. IV of the Bylaws is needed in order to:

  • Extend to five years the period between each consecutive review of the same key structure of ICANN; this longer period of time will allow a more accurate assessment of the effects of the changes introduced following each review process.
  • Clarify that the period between two consecutive reviews should be computed from the moment of the reception by the Board of the final report of the relevant review Working Group.

The whole chapter 2 of the Section 4 of Article IV –containing a calendar of the first planned reviews- is furthermore removed from the proposed reformulation, because it is obsolete.
